The Fusion Collective is a division of AD Creative Enterprises LLC. By engaging with our services, attending our events, or joining our community, you agree to be bound by the following Terms and Conditions.
1. Core Values & Community Standards
The Fusion Collective is built on the pillars of Creative Freedom, Participatory Culture, and Multidimensional Performance. We believe in a radical, open-minded approach to art and community engagement.
Expected Conduct: All members, artists, and event attendees are expected to act in accordance with these core values. We prioritize respect, inclusivity, and the safety of our creative space.
Right of Refusal:The Fusion Collective reserves the right, at its sole discretion, to remove any individual from our community, digital platforms, or physical events who acts out of accordance with these values or disruptive to the collective environment.
No Refunds for Conduct: In the event of removal due to a violation of these community standards, no refunds for tickets, memberships, or services will be issued.
2. Ticketing, Events, and NYC Compliance
All Sales Final: All ticket purchases for The Fusion Collective events are final. Refunds will only be issued if an event is officially canceled by The Fusion Collective and not rescheduled.
Tax Clause: All ticket prices are exclusive of applicable sales tax. In accordance with New York State and City tax laws, appropriate sales tax will be calculated and added at the time of checkout via our ticketing partner, Humanitix.
Media Release: By attending a The Fusion Collective event, you grant AD Creative Enterprises the royalty-free right to use your likeness, voice, and image in photographs or video recordings for marketing and promotional purposes across all media. You may revoke this right by sending a request via email to hello@thefusioncollective.co.
3. Intellectual Property & Artist Rights
We believe the creator is the soul of the work. The Fusion Collective is committed to an artist-first model.
100% Ownership: The Artist retains one hundred percent (100%) ownership of all original work created through or for The Fusion Collective. While work may be designated as "Work for Hire" in relation to end-clients, the underlying intellectual property remains with the Artist.
Limited Promotional License: The Artist grants The Fusion Collective and its parent company, AD Creative Enterprises, a non-exclusive, worldwide, royalty-free license to use, display, and distribute the work solely for marketing, portfolio, and promotional purposes (e.g., social media, website, and pitch decks).
Expiration: This promotional license shall remain in effect for a period of twenty-four (24) months from the date of the work's first public display or event. After this period, The Fusion Collective must seek written renewal from the Artist to continue using the work in new marketing materials. (Existing archived posts on social media feeds are exempt from removal, but no new promotions will be created).
4. Communication & Privacy
Automatic Subscription: By registering for an event or joining the community, you will be automatically subscribed to The Fusion Collective mailing list.
Data Separation: Your data is used specifically for The Fusion Collective ecosystem. You will not be automatically added to the general AD Creative Enterprises or other company divisions’ mailing listswithout your explicit consent.
Opt-Out: You are free to opt-out of marketing communications at any time via the "Unsubscribe" link in any email.
5. Limitation of Liability & Governing Law
Liability: To the maximum extent permitted by law, The Fusion Collective and AD Creative Enterprises shall not be liable for any indirect, incidental, or consequential damages arising from your participation in our events or community.
Governing Law: These terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any legal action or proceeding shall be brought exclusively in the courts located in New York, NY.
